Terms of service
The terms that apply when you use this website or engage Full Set Property Pty Ltd for property services.
1. About these terms
These terms apply to your use of fullsetpropertytec.site and to any services provided by Full Set Property Pty Ltd (ABN 54 703 636 926, ACN 703 636 926) ("we", "us", "our"). By using this website or engaging us, you agree to these terms. Where we give you a written quote or agreement for a particular job, its specific terms apply alongside these, and prevail if the two conflict.
2. Our services
We provide property maintenance coordination, fit-out and presentation works, and practical support for property owners, managers and agents. We are not a licensed real estate agency, and nothing we do is an offer to sell, lease or manage property as an agent. Where work needs a licensed or registered tradesperson, it is carried out by an appropriately qualified person.
Information on this website is a general description of our services. It is not a quote and does not form an offer.
3. Quotes and payment
We confirm the scope and price of each job in writing before work begins. If additional work becomes necessary once a job is under way, we will seek your approval before proceeding. Payment terms are set out on each quote or invoice.
4. Your responsibilities
You agree to give us accurate information about the property and the work required, to arrange or authorise reasonable access, and to tell us about any known hazards. Where you are acting for an owner, you confirm that you have authority to engage us.
5. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). These include that services will be provided with due care and skill, will be fit for any purpose you have made known to us, and will be supplied within a reasonable time.
If a service fails to meet a consumer guarantee, you are entitled to the remedies the Australian Consumer Law provides. For a major failure, you may be entitled to cancel the service and receive a refund for the unused portion, or compensation for its reduced value. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.
6. Limitation of liability
To the extent permitted by law, and subject to section 5, where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again.
To the extent permitted by law, we are not liable for indirect or consequential loss, including loss of rent, income or opportunity, arising from our services or your use of this website. Nothing in this section limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence.
7. Intellectual property
The content, design and text of this website are owned by or licensed to Full Set Property Pty Ltd. You may view and print pages for your personal use, but you may not copy, reproduce or republish them for commercial purposes without our written permission. Reports and job summaries we prepare for you may be used by you for your own property records.
8. Use of this website
We take care to keep this website accurate, but do not warrant that it is complete, current or free of errors, and we may change its content at any time. You must not use the website in a way that is unlawful or that could damage it or impair its availability.
9. Termination
Either party may end an engagement by written notice. If you end an engagement, you will pay for work completed and costs reasonably incurred up to the date of notice. We may suspend or end an engagement if you breach these terms, if payment is overdue, or if conditions at the property make it unsafe to continue. Your rights under the Australian Consumer Law are not affected.
10. Governing law
These terms are governed by the laws of the State of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
